Terms of Service

These Terms of Service ("Terms") govern your use of the CNS Logistics website at cnslogistics.ca (the "Site") and any moving services provided by CNS Logistics ("Logistiques CNS", "CNS", "we", "us", "our"). By accessing or using our Site or services, you agree to be bound by these Terms.

1. Services

CNS Logistics provides residential, commercial, and long-distance moving services, as well as storage, packing, piano moving, senior moving, laboratory and medical equipment moving, and law firm office relocation services. Service availability, pricing, and scope are determined on a per-move basis through our quote process.

2. Quote Requests and Estimates

• Quotes provided through our website or by phone are estimates based on the information you provide. Final pricing may vary based on actual move conditions (access, weight, distance, additional services required).
• A quote is not a binding contract until confirmed in writing by a CNS Logistics project manager.
• We aim to respond to all quote requests within 24 hours during business days.
• Prices are quoted in Canadian dollars (CAD) and are subject to applicable taxes (GST/QST).

3. Booking and Cancellation

• Moves are confirmed upon written acceptance of the estimate and any required deposit.
• Cancellations made 72 hours or more before the scheduled move date are eligible for a full deposit refund.
• Cancellations made less than 72 hours before the move may be subject to a cancellation fee.
• Rescheduling is subject to availability and must be requested at least 48 hours in advance.
• These cancellation terms apply subject to applicable consumer protection law. Where the Québec Consumer Protection Act grants additional cancellation rights, those rights prevail over these Terms.

4. Customer Responsibilities

To ensure a smooth and efficient move, you agree to:

• Provide accurate and complete information about your move (addresses, access conditions, inventory, special items)
• Ensure that pickup and drop-off locations are accessible to our trucks and crew on the scheduled date
• Obtain any required parking permits for truck access at both locations
• Inform us of any items requiring special handling (pianos, safes, laboratory equipment, fragile or high-value items)
• Be present or designate a representative at both the pickup and drop-off locations
• Ensure that all items are packed and ready for loading at the agreed start time (unless packing services are included)

5. Insurance and Liability

• CNS Logistics carries commercial general liability insurance and cargo insurance. Specific coverage details, limits, and exclusions are provided in your written moving contract and estimate.
• Basic liability coverage is included with every move. Extended coverage options are available upon request.
• We ask that claims for damaged or lost items be reported as soon as possible after the move, ideally within a reasonable timeframe. Nothing in these Terms limits any rights you may have under applicable law, including the Québec Consumer Protection Act and the Civil Code of Québec.
• CNS Logistics is not liable for items packed by the customer (owner-packed boxes), pre-existing damage, or damage caused by inadequate access conditions not disclosed prior to the move.
• Our liability does not extend to items of extraordinary value (jewelry, cash, important documents, irreplaceable personal items) unless specifically declared and insured prior to the move.

6. Payment Terms

• Payment is due upon completion of the move unless otherwise agreed in writing.
• We accept cash, credit cards (Visa, Mastercard), debit, and e-transfer.
• For long-distance moves, a deposit may be required at the time of booking.
• Outstanding balances after 30 days are subject to interest charges as permitted by Quebec law.

7. Website Use

• All content on this Site (text, images, logos, design) is the property of CNS Logistics and is protected by Canadian copyright law.
• You may not reproduce, distribute, or use any content from this Site without our written permission.
• The Google Maps features on our Site are subject to Google's Terms of Service.
• We are not responsible for the accuracy of third-party content, including Google Maps data and directions.

8. Privacy

Your use of our Site and services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy at cnslogistics.ca/privacy-policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CNS Logistics shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our Site or services. Our total liability for any claim related to our services shall not exceed the total amount paid for the specific move in question. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the Québec Consumer Protection Act and the Civil Code of Québec.

10. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the judicial district of Montreal.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top indicates the most recent revision. Continued use of our Site or services after changes constitutes acceptance of the revised Terms.
